CDC Race Club – Booking Terms, Waiver & Consent
IMPORTANT NOTICE – PLEASE READ CAREFULLY
By booking with CDC Race Club, you acknowledge that ski training involves risks and that you will waive certain legal rights, including the right to sue for certain claims. This agreement is legally binding.
1. Introduction & Definitions

These booking terms (“Booking Terms”) apply to all training courses (“Training Courses”) provided by CDC Race Club, River Cottage, Hampton Court Road, East Molesey, Surrey KT8 9BP (“CDC”).

CDC includes its directors, staff, coaches, volunteers, and representatives.

Trainee/Participant means the individual taking part.

Parent/Guardian means the person with legal responsibility for a Child Trainee.
-
Adult means a participant aged 18+. Child means a participant under 18.
-
Skiing includes skiing, cross-country skiing, alpine racing, and related activities.
2. Bookings & Payments

For Child Trainees, bookings must be completed by a Parent/Guardian.

A binding contract is formed when the booking form is submitted, payment is made, and CDC issues confirmation.

Full payment must be made by the deadline. CDC may cancel the booking without refund if balances are unpaid.

Trainees must join Snowsport England (minimum Blue membership) after a maximum of three trial sessions for insurance purposes.
3. Cancellations & Refunds
Cancellation by the Client

If cancellation is made more than seven (7) days before the start date of the course, a full refund will be given.

If cancellation is made between three (3) and seven (7) days before the start date, a refund will only be given if CDC is able to fill the space with another participant.

If cancellation is made within seventy-two (72) hours of the start date, or if the participant does not attend, no refund will be given.

For courses consisting of multiple sessions, no refunds, reductions, or credits will be given for missed sessions.
Cancellation by CDC

If a session is cancelled due to circumstances beyond CDC’s reasonable control (for example, adverse weather, slope closure, or mechanical failure), CDC may offer a refund, credit, or reschedule at its discretion.

If a session is cancelled due to reasons within CDC’s reasonable control (such as insufficient staff or participant numbers), a full refund of the affected session(s) will be given. Participants will be notified as soon as reasonably possible.
Insurance

Refunds are not available for unused services. Clients are encouraged to take out suitable travel or activity insurance to cover any cancellation costs.
4. Medical & Safety

You must disclose all relevant medical conditions and notify CDC of any changes.

Emergency treatment consent: If a Parent/Guardian cannot be contacted, CDC staff are authorised to act in loco parentis and consent to emergency treatment as deemed necessary by qualified medical professionals or first aiders.

Medicines must be labelled and handed to CDC staff on arrival.

Protective equipment: Helmets are mandatory; gloves, long sleeves, and full-length trousers are required due to abrasive surfaces. Back protectors are strongly recommended (mandatory for some training/races).
5. Behaviour & Code of Conduct

Trainees must follow CDC’s Code of Conduct and staff instructions.

Serious misconduct (including bullying, discrimination, theft, violence, drug/alcohol use, sexual activity for under-18s, or refusal to follow reasonable instructions) will result in removal from the course without refund.

Parents of Child Trainees must arrange immediate collection if expulsion occurs.
6. Consent & Data Protection

By booking, Parents consent to CDC staff acting in loco parentis for Child Trainees in emergencies.

Training may be video-recorded for coaching purposes.

Use of photos/videos for CDC publicity (e.g. social media, website) is opt-in via the booking form. All videos and photos will comply with the Photographic policy on the website.

CDC handles data in compliance with UK GDPR and the Data Protection Act 2018.
7. Liability & Assumption of Risk

By booking you understand that dry slope skiing is inherently dangerous and can involve the risk of death, permanent paralysis and bodily injury. It is therefore of great importance that those using dry slope ski facilities adhere to all the rules, regulations, policies and signage. These are for both your and other slope users’ safety and enjoyment.

Under no circumstance should a member of public enter the dry slope or tamper with or adjust any equipment/item belonging to the dry slope or CDC.

The trainee is participating on the training course by their own free will and they acknowledge that skiing involves many risks, dangers and hazards including but not limited to: boarding, riding and disembarking ski lifts; changing weather conditions; changes or variations in the terrain which may create blind spots or areas of reduced visibility.

In consideration of being allowed to participate in the training course, I, for myself and my heirs and executors, agree to indemnify and otherwise hold harmless CDC and all other persons associated with the training course for all liabilities, claims, actions, or damages that I may have against them arising out of, or in any way connected with, my participation in the training course caused by my negligence or failure to follow proper instructions.

CDC shall have no liability for any indirect or consequential loss arising under or in connection with the Contract. Nothing in the Contract shall limit or exclude CDC’s liability for (i) death or personal injury caused by its negligence; or (ii) fraud or fraudulent misrepresentation.

CDC’s total liability in respect of all other losses arising under or in connection with the Contract shall be limited to the full cost of the relevant Training course. CDC shall not be liable as a result of any delay or failure to perform its obligations under the Contract as a result of an event beyond the reasonable control of CDC such as inclement weather, dry slope or lift closure or floodlight failure, high winds, electrical storms, industrial disputes, failure of any transport system, accident or default of suppliers or subcontractors or staff illness.
8. General
These terms are governed by English law and subject to the exclusive jurisdiction of the courts of England and Wales.
Certain clauses (e.g. liability, medical consent, data protection) survive termination of the contract.
9. Acknowledgement
By booking, I confirm that:
-I have read and understood these terms;
-All information provided is accurate and complete;
- I accept the risks of ski training; and
- I understand I am waiving certain legal rights by agreeing to this waiver.
